2 – OUR PRODUCTS

Every effort has been made to accurately represent the original artwork, fine art prints, commissioned pieces, personalized products, and other offerings available through the Dot JPG Designs website. Because many works are handcrafted and created individually by artist Jacqueline Powell Gibson, each piece is naturally one of a kind.

Please note that colors, textures, and the appearance of artwork or products may vary slightly depending on your screen, monitor settings, lighting conditions, or device. Likewise, handmade artwork may include subtle variations that are part of the artistic process and should not be considered defects.

While Dot JPG Designs strives to provide accurate descriptions, photographs, and specifications for every product, we do not guarantee that artwork or products will appear exactly as displayed on your device or meet subjective personal expectations.

All product descriptions, materials, dimensions, pricing, availability, and offerings are subject to change without notice at the sole discretion of Dot JPG Designs. We reserve the right to discontinue any product or service or limit the quantities available to any individual, geographic region, or jurisdiction on a case-by-case basis.

3 – ORDERS

By placing an order through the Dot JPG Designs website, you are submitting an offer to purchase artwork, products, or services from Dot JPG Designs, operated by artist Jacqueline Powell Gibson.

Dot JPG Designs reserves the right to accept, decline, modify, or cancel any order at its sole discretion. An order is not considered accepted until payment has been successfully processed and an order confirmation has been issued.

Many products offered through this website, including original artwork, commissioned pieces, personalized items, and made-to-order products, are created specifically for each customer. For this reason, customers are encouraged to carefully review all order details, personalization information, and shipping addresses before submitting an order, as cancellation requests may not be accommodated once production has begun.

If an order cannot be accepted, requires modification, or is canceled, Dot JPG Designs will make reasonable efforts to notify you using the email address, billing information, or telephone number provided when the order was placed.

Returns, exchanges, and refunds are governed exclusively by the Refund Policy available on this website.

By placing an order, you represent and warrant that purchases are made for your own personal or household use and are not intended for commercial resale, redistribution, reproduction, or export without prior written permission.

4 – PRICES AND BILLING

Prices, promotions, discounts, and product availability are subject to change without prior notice. The price charged for any artwork, product, commission, or service will be the price in effect at the time your order is placed and will be reflected in your order confirmation email. Unless otherwise stated, listed prices do not include applicable taxes, shipping, handling, customs duties, import fees, or other charges that may apply to your order.

Prices listed on the Dot JPG Designs website may differ from prices offered at in-person events, gallery exhibitions, pop-up markets, retail locations, or through authorized third-party retailers. From time to time, Dot JPG Designs may offer special promotions or limited-time pricing that are governed by separate terms and conditions. If a conflict exists between the terms of a promotion and these Terms of Service, the promotion terms will apply.

You agree to provide current, complete, and accurate billing, payment, shipping, and account information for all purchases made through the Services. You also agree to promptly update your account information, including your email address, payment information, and shipping details, so that orders may be processed successfully and we may contact you if necessary.

By submitting payment information, you represent and warrant that: (i) all payment information provided is true, accurate, and complete; (ii) you are authorized to use the selected payment method; (iii) charges incurred will be honored by your payment provider; and (iv) you are responsible for paying all charges associated with your order, including applicable shipping, handling, taxes, customs duties, and other fees.

5 – SHIPPING AND DELIVERY

Every order is carefully prepared and packaged by Dot JPG Designs to help ensure it arrives safely. Shipping and production timelines provided throughout the website are estimates only and are not guaranteed.

Many items offered through the Services, including original artwork, commissioned pieces, and personalized products, are created or prepared specifically for each order. Production times will vary depending on the nature of the artwork, current studio workload, and seasonal demand.

Once an order has been shipped, delivery times are the responsibility of the shipping carrier. Dot JPG Designs is not liable for shipping or delivery delays caused by carriers, weather, customs processing, supply chain disruptions, incorrect shipping information provided by the customer, or circumstances beyond our reasonable control.

Ownership of and risk of loss for purchased products transfers to you upon delivery of the order to the designated shipping carrier. Customers are responsible for providing a complete and accurate shipping address at checkout. Dot JPG Designs is not responsible for orders delayed, lost, or misdelivered due to incorrect shipping information supplied by the customer. The studio's full shipping policy can be found here.

6 - INTELLECTUAL PROPERTY

All content, artwork, and materials available through our Services, including but not limited to trademarks, branding, written content, artwork, illustrations, photographs, images, graphics, product descriptions, reviews, videos, audio, and the overall design, selection, and arrangement of these materials, are the intellectual property of Artist Jacqueline Powell Gibson, Dot JPG Designs, and/or our affiliates, partners, or licensors. These materials are protected by United States and international copyright, trademark, and other applicable intellectual property laws.

However, any sales and purchases you make in our Store are made directly with Artist Jacqueline Powell Gibson. THIS LIMITATION APPLIES TO ANY CLAIM ARISING FROM YOUR USE OF OUR SERVICES, ANY PRODUCTS PURCHASED THROUGH OUR SERVICES, ANY ERRORS OR OMISSIONS IN OUR CONTENT, OR ANY LOSS, DAMAGE, OR ISSUE RESULTING FROM CONTENT, PRODUCTS, OR MATERIALS MADE AVAILABLE THROUGH OUR SERVICES, EVEN IF ARTIST JACQUELINE POWELL GIBSON OR DOT JPG DESIGNS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

18 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Artist Jacqueline Powell Gibson, Dot JPG Designs, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any claims, damages, losses, liabilities, expenses, or costs (including reasonable attorneys’ fees) arising from or related to:

We will not agree to any settlement that requires you to take non-monetary action without your consent, which shall not be unreasonably withheld.

You agree to reasonably cooperate in the defense of any indemnified claim, including providing relevant information, documentation, and assistance as needed.
